General Terms and Conditions:

Welcome to "Amor e Paixão". The following Terms and Conditions govern the relationship betweenAmor e Paixão (hereinafter referred to as "AS") and users and customers of its Entertainment and Chat services (hereinafter referred to as "User"). The conditions under which the Services offered by "Amor e Paixão" are used and defined.



1. Acceptance of the General Terms and Conditions Agreement

By creating an account on the ''Amor e Paixão'' website, whether with a mobile device, or a computer (collectively, the "Service"), the User agrees to the following Terms of Use.

"AS" may make changes to this Agreement and the Service whenever it deems necessary. We may do so for a variety of reasons, such as to reflect changes in law or regulations, new functions or changes in business practices. The most current version is always the valid version. If the changes include material changes that affect your rights or obligations, we will provide you with reasonable notice of those changes, via messages through the Service or by email, for example. If you continue to use the Service after the review, you agree to the revised Agreement.



2. Access

Access to the "AS" database and services is granted after the User has registered. During registration, a password and an alias specified by the User are used. Registration requires the User to also enter an email address and complete the registration form completely.



3. Scope of Services

"AS" allows Users to access a central database system via computer or mobile phone. This database system contains profiles and information about other Users. After registering and creating their own profile, Users have the option to search for other profiles in the database. Users can view other Users' profiles and contact them. In addition, "AS" offers access to data from a selection of Users as part of their access to the database system. The content, type and duration of the data material provided and transmitted by the respective User is the sole responsibility of the User.

"AS" provides both free and paid services. With the free registration, the User can create a profile, view the profiles of other Users and read messages from other Users. Likewise, a User can "like" the profiles of other Users for free. If two Users tag each other's profile, this is shown to both Users. Hereinafter referred to as "Common Tastes". You can also block users completely free of charge.

In addition to the free Services listed above, the User may contact other Users and write messages to them for a fee. Before these Services are provided, the User is informed of the costs, content and scope of the Services, as well as the price and payment terms.



4. Authorization

Minors and persons acting on behalf of third parties are excluded from using the "AS" Services. If "AS" has reason to suspect that a person is not entitled to participate on the website, "AS" will have the right to verify the person's personal data, validating their identity by requesting official documents. Users who do not have the right to participate are excluded from using the "AS" Services and the database.

By creating an account and using the Service, the User represents and warrants that:

- May enter into a binding contract with "AS";

- Will comply with this Agreement and all applicable local, state, national and international laws, rules and regulations;

- Never commit a serious crime or a punishable act (or a similar crime), a sex crime or a violent crime and who are not listed as sex offenders in any city.



5. Termination of Free Membership

A user has the right to delete their profile at any time without giving any kind of explanation. Furthermore, "AS" reserves the right to refuse the registration of a User at any time without stating the reasons.

If the User violates these General Terms and Conditions, "AS" may terminate membership at any time without prior notice.
Upon termination of membership, all operator obligations to store User data cease, unless statutory retention periods require storage.

6. Modification of the Services

"AS" always strives to improve the Service and provide Users with additional features that they find appealing and useful. This means that, from time to time, "AS" will introduce new features or improvements to the product and remove some features, and if these measures do not materially affect the rights or obligations of Users, "AS" may do so without prior notice. to Users. "AS" may even completely suspend the Service, in which case "AS" will notify Users in advance, unless extenuating circumstances, such as security concerns, prevent it.

7. Shopping

In addition to the free Services, "AS" offers the User a number of fee-based services and benefits. With each individual use of these Services, the User enters into a new contractual relationship with "AS". Each use of a Service constitutes a new contractual relationship. These services are completely disconnected from the free use of the "AS" database system. Individual contracts do not constitute subscriptions.
The contract is concluded by the User by selecting the Service in charge and accepting the payment obligation by pressing the "Buy" button (hereinafter: Order Process). Chargeable Services are also subject to local terms and conditions.

Shopping "Amor e Paixão"

If you choose to make a purchase through "Amor e Paixão", you agree to pay all fees at the price indicated for the selected Services, as well as any costs or taxes that may be incurred in your payments. In addition, "Amor e Paixão" is authorized to charge the selected payment provider (the User's "payment method"). "Amor e Paixão" can correct any errors or billing errors, even if payment has already been requested or received. If the User reverses a transaction or otherwise reverses a payment through their payment method, "AS" may, in its sole discretion, immediately delete the User's account.

"Stars"

By concluding a payable contractual relationship, the User receives an amount selected in the Order Process, which is credited in the form of a credit account. The credit balance is denominated in so-called "Stars". For a consumption of 1 "Stars", the User can send a message to other Users. If the credit account no longer contains "Stars", it is not possible to send another message to other Users. The User can re-add "Stars" to their credit account through the Order Process, through which a new purchase contract is concluded.

Virtual Items

The "Stars" are virtual items that the User can purchase.

The User is only authorized to purchase virtual items via "Amor e Paixão" and by no other means. Virtual Items form a limited license subject to this Agreement. Unless otherwise prohibited by applicable law, virtual items purchased by the User will be licensed to the User and the User acknowledges that no title or ownership of the virtual items will be transferred or assigned to the User. This Agreement will not be construed as a sale of rights to virtual items. No account balance in the User's account with respect to the virtual items represents a real-world account balance or reflects any stored values, but represents a measure of the scope of the User's license.
There are no fees for virtual items if they are not used, but the license granted to the User for the virtual items ends, in accordance with the terms of this agreement, if "AS" ceases to provide the Service or if the User's account is closed or terminated. . "AS" reserves the right, in its sole discretion, to charge fees for the right to access or use Virtual Items and/or may distribute Virtual Items for a fee or free of charge. "AS" can manage, regulate, control, modify or remove virtual items at any time. If "AS" exercises any of these rights, "AS" will not be responsible for the User or for third parties. The transfer of virtual items is prohibited, and the User may not sell, take back or transfer virtual items to any natural or legal person. Virtual items can only be collected through the Service.

8. Payment Terms

The Fee for Paid Services must be paid in advance to "AS" and is charged in full by the payment method selected in the Order Process, such as credit card, direct debit, online transfer (SEPA), Paysafe Card or PayPal. Upon successful completion of the Order Process, the "Stars" will be credited to the customer's account immediately, which may take up to 2 hours. When purchasing with a credit card, "Amor e Paixão" will appear in the description of your Order.

"AS" may have fee-based service payments processed by an external service provider appointed by "AS".

9. Usage Obligations

The User is solely responsible for the content of his registration, for more personal data and, therefore, for the information he provides about himself. The User affirms that the data provided is true and is personally described. Intentional or fraudulent false statements may result in legal and criminal proceedings and give "AS" the right to block the User's profile without affecting "AS"'s right to remuneration.

The User states that he/she does not use "AS" Services for commercial purposes, namely for advertising purposes. The User is not authorized to manually read the contents and profiles of other Users or with computer programs to use the data obtained in this way.

The User undertakes to treat his login data confidentially. If the login data is transmitted to third parties, the User is responsible for all consequences of the action. If you suspect that the access data has been sent to third parties, the User must immediately inform "AS" and take appropriate measures to prevent further misuse (eg by changing the password).

The user is prohibited from providing any type of explicit content.

Furthermore, the User undertakes not to abuse the Services of "AS", goods such as:

- Do not use them to spread defamatory, racist, inciting or otherwise illegal material or information;

- Do not solicit illegal pornography through the database system or from other Users;

- Do not use them to threaten or harass other Users or violate their rights (including personal rights);

- Do not enter any data into the system or database that contains a virus, software or other material protected by copyright or other protection rights, unless the User is the owner of the respective rights or has the necessary consent for the its use;

- And not use them in a way that negatively affects the availability of the Services to other Users;

- Do not intercept any emails or other messages and do not attempt to do so;

- Do not send repeated sentences in a chain;

- Do not send emails or other messages that serve for commercial purposes;

- Not mentioning any names, addresses, phone or fax numbers, messenger addresses, emails or URLs in the profile data;

- Not to collect, store or process any personal data about other Users.

Failure to comply with the aforementioned obligations or breach of other obligations regulated in these General Terms and Conditions shall allow "AS" to immediately block the User's access to the database and terminate the contract without prior notice for imperative reasons.

The User is also obliged to follow the "AS" photography/image policy.

10. Violation of Usage Obligations

If the User violates these General Terms and Conditions, "AS" may terminate the subscription at any time without prior notice and the User's account will be deleted.

11. Communication
"AS" creates an email box for the User in his/her account/profile. This is to contact other Users and transmit messages from the "AS" Service. Other communications from "AS" to the User will be made through the email address provided by the User.

Users of the "AS" database are provided with a chat for the mutual exchange of information in text form. The Users themselves are responsible for managing the communication between them and ensuring an adequate form of expression. Sexually objectionable statements at the outset and statements during communication should be avoided.

A chat can be initiated by the User at any time. Users who have a predefined number of "Stars" can write to other Users for their fee, "1 Stars" per message.

A User receives push notifications by default. Notifications include notices of incoming chat messages, profile visits by other Users, profile likes by other Users, and common profile likes by other Users. Notifications can be turned off in the application settings.

"AS" uses or may use professional animators and operators for the entertainment of Users, who are not separately identified in the system. This Service will always be provided of the highest quality. Real encounters with these operators are not possible. Users can only send them messages within the site.

12. Advertising and Newsletters

By registering on "AS", the User expressly agrees that messages with information about my Likes, as well as information about other Users, may be sent to them. The User has the right to disable mail in the account settings at any time.

13. Commercial or business use bans, spam ban

The User guarantees that he is not pursuing any commercial and/or business interest related to its use. You agree not to use the "Amor e Paixão" website for commercial or business purposes.

Advertising for commercial or business Internet pages or applications, namely those that:

- Offer of goods or services for monetary value, request for an equivalent offer or reference to an equivalent offer that can be obtained elsewhere

- Advertising for commercial or business websites or applications, in particular those that offer goods or services against payment, are used for the presentation or advertising of companies, or to advertise other commercial portals.

This applies in particular to advertising of companies in the form of pop-ups, banner advertising or via specially highlighted or visible links. A website is considered commercial if it links directly or indirectly to another operator's commercial website.

Establish contact with the aim of making a subsequent profit, namely through subsequent referrals to non-service numbers or premium rate SMS DE numbers.

The User undertakes not to advertise commercial offers to other Users of the Service here or to other Users in any way and not to send messages that serve commercial or business purposes. This also refers to defining or naming links in publicly accessible profiles or sending messages with internal messaging systems (eg messaging, and profile data).

14. Damage

A User who proceeds or uses the site "Amor e Paixão" for commercial or business purposes of point 12 without the authorization of "AS" is obliged to pay a compensation of € 5,100. In this case, the User can prove that no damage was caused or that it is significantly less than the fixed amount. "AS" reserves the right to prove that it has suffered greater damages.

In the event of an intentional or grossly negligent breach of the User's obligations referred to in point 8, the User undertakes to pay compensation to "AS", unless the breach already constitutes a lump sum compensation in accordance with paragraph 1 of this Score. In this case, the User is authorized to prove that damage has occurred.

15. Third Party Services

The Service may contain advertisements and promotions offered by third parties, as well as links to other websites or internet resources. "AS" is not responsible for the availability (or lack of availability) of such external websites or internet resources. If the User decides to interact with third parties through the Services of "AS", the relationship between them and the User is subject to the terms and conditions of these third parties. "AS" is not responsible for the terms or actions of such third parties.

16. Change of General Terms and Conditions

"AS" reserves the right to change these General Terms and Conditions at any time, as this does not affect the essential provisions of the contractual relationship and is necessary to adapt to developments that were not foreseeable for "AS" " at the time of conclusion of the contract and the non-compliance that would visibly disturb the balance of the contractual relationship. The essential provisions are, inter alia, those relating to the type and scope of services agreed, as well as the term, including provisions on termination. "AS" has the right to make changes to fill any gaps in the contract, namely due to legal changes and changes in jurisprudence.

17. Responsibility of "AS"

"AS" assumes no responsibility for the accuracy and security of data and content published or transmitted by other Users. "AS" also assumes no responsibility for the correction of the content of the User's profiles. Although this is not permitted, Users may enter incorrect or illegal information and content or use "AS" Services for inappropriate or illegal purposes.
"AS" provides an IT service with access to the database and does not guarantee its success. As "AS" has no influence on the transmission of data over the internet outside its own IT infrastructure, and due to the characteristics and uncertainties of the internet, "AS" cannot accept any responsibility for such external data loss. and/or errors in data transmission. "AS" is not responsible for any failure of the offer that is beyond its control (for example, due to a case of force majeure or technical malfunctions of the internet).

"AS" assumes no responsibility for the misuse of information provided by the User to third parties. "AS" is also not responsible for unauthorized access by third parties to Users' personal data (for example, through unauthorized access to the central database), unless "AS" has deliberately or grossly or even negligently the unauthorized access by third parties.

"AS" is only liable - except in the case of breach of essential contractual obligations, in case of injury to life, body or health or in case of claims arising from the Product Liability Act - for intent and gross negligence. Essential contractual obligations are those whose fulfillment is necessary to achieve the purpose of the contract.

In the event of a minor negligent breach of an essential obligation for the performance of the contract (cardinal obligation), the liability of "AS" will be limited in amount to the foreseeable damages typical of the type of activity in question.

The above limitation of liability also applies to the personal liability of "AS" employees, representatives and agents.

18. Rights

The User grants "AS" a non-exclusive, transferable, geographically unlimited and temporally limited right of use to the contents created or uploaded by them to the database, including images, texts and videos.

The User guarantees that the contents published or created by them and their use do not violate the rights of third parties, namely copyright or other property rights.

19. Data Protection

"AS" collects, processes and uses the User's personal data as described in these Terms and Conditions and the Privacy Policy. The storage of personal data is governed by legal provisions.

20. Offensive or inappropriate content
20.1 Definition
Offensive or inappropriate Content is any behavior that includes:
- Defamatory comments and hate speech about religion, gender, race and other target groups;
- Sexual material of an explicit nature;
- Depictions of extreme violence or content that encourages violence;
- Intimidation and harassment;
- Illegal activities such as drug use and gambling;

If you post or send content that is offensive, inappropriate or objectionable to any member or on any part of the Amor e Paixão website, or if you engage in any disruptive or destabilizing behavior on the platform , we may immediately block your access to the platform.

21. Cancellation Instruction

1 - Right to Cancellation
The User has the right to cancel contracts created within 14 days without reason. The revocation period is fourteen days from the day of individual conclusion of the contract. To exercise the right of cancellation, the User must inform us ("Amor e Paixão") by means of an unequivocal statement (eg an email) of his decision to cancel this contract. To comply with the withdrawal period, simply send the notification of the exercise of the right of cancellation before this cancellation period expires.

2 - Cancellation of any "Vip Area" Subscriptions

If the User wants to cancel and not be charged again for his subscription to access all the features as a "VIP" member, it is enough that he does not renew the plan again and when the subscription expires, the account will be without the features again. "VIP".

If the User has given his express consent, the right of cancellation expires prematurely if the Service requested by the User has been fully provided by "AS" before the User has exercised his right of cancellation.

22. Final Provisions

The legal relationship between "AS" and the User is governed by the law of Portugal, subject to any mandatory provisions. The place of jurisdiction for all claims arising from this contract is in Portugal, insofar as the User is not a customer. The applicability of the mandatory regulations of the State in which the User has his habitual residence or domicile at the time of conclusion of the contract remains unchanged.
If the individual provisions of these General Terms and Conditions are invalid or incomplete, the validity of the remaining General Terms and Conditions will remain unchanged.
